If we cannot resolve a dispute informally, you and Caliana Press agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or our services through binding arbitration rather than in court, except that either party may bring claims in small claims court if they qualify.
Arbitration Rules:
- Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules
- Arbitration will be conducted in Pierce County, Washington, or remotely by video/phone
- The arbitrator’s decision will be final and binding
- Judgment on the award may be entered in any court of competent jurisdiction
Class Action Waiver:
YOU AND CALIANA PRESS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding.
14.3 Exceptions to Arbitration
The following disputes are NOT subject to arbitration:

For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Pierce County, Washington, USA.
15.3 Waiver of Jury Trial
TO THE EXTENT PERMITTED BY LAW, YOU AND CALIANA PRESS WAIVE ANY RIGHT TO A JURY TRIAL IN ANY PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS.
16. Force Majeure
Caliana Press shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to:
- Acts of God, natural disasters, or severe weather
- War, terrorism, or civil unrest
