If we cannot resolve a dispute informally, you and Caliana Press agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or our services through binding arbitration rather than in court, except that either party may bring claims in small claims court if they qualify.

Arbitration Rules:

• Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules
• Arbitration will be conducted in Pierce County, Washington, or remotely by video/phone
• The arbitrator’s decision will be final and binding
• Judgment on the award may be entered in any court of competent jurisdiction

Class Action Waiver:

YOU AND CALIANA PRESS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding.

14.3 Exceptions to Arbitration

The following disputes are NOT subject to arbitration:

• Claims for injunctive or equitable relief for intellectual property infringement
• Claims that qualify for small claims court

14.4 Opt-Out

You may opt out of the arbitration agreement by sending written notice to legal@calianapress.com within 30 days of first accepting these Terms. The notice must include your name, address, and a clear statement that you wish to opt out.
